What
is RERA Act, what is the rule and how to complain in it .
The Government of India had implemented an Act in the year
2017, under which all illegal activities related to real estate i.e. land or
property can be banned. This act was named 'Real Estate (Regulation and
Development) Act or RERA, in many places builders and property dealers were
taking money from customers illegally for a long time, and the flats were of
substandard quality. The construction was being given, to control which this
act has been implemented. What is RERA law, what is the rule and how to

What
is RERA Act
The full form of RERA is Real Estate Regulation and
Development Act (RERA). This is an Act of the Parliament of India in the year
2016, this act has been made to protect the interest of home buyers and to
promote good investments in the real estate industry. The bill was passed by
the Rajya Sabha on 10 March 2016 and in the Lok Sabha on 15 March 2016. A total
of 92 sections have been made in this. The Act came into force on 1st May 2016
with 69 notified categories.
The act has been enacted keeping in view the increase in
complaints against builders, promoters and real estate agents. These complaints
mainly include delay in possession of the house for the buyer, irresponsible behaviour
of the promoters even after signing the agreement and various types of
problems. Under this an authority will be constituted. It aims to protect the
interests of buyers as well as set a path for promoters and real estate agents.
Main
provisions of the Act

Real estate regulatory commission or authority
will have to be constituted at the state level. Its work will be to register
the real estate project in the state. Resolving disputes between developers and
buyers and monitoring project completion on time

Provision for settlement of disputes by quick
tribunals within 60 days
·
It is mandatory for all construction plans to be
registered with the Real Estate Regulatory Authority, except for construction
plans up to five thousand square feet or eight apartments.

Provision to keep 70% of the amount taken from
customers in a separate bank and use it only for construction work
·
Provision to compulsorily give details of
project related information, such as layout, approval, contractor and life of
the project to the buyer
In this, an online application has to be made for
registration. Documents certifying the validity of the project, company
registration, PAN card, photo, registration certificate, fee chart, engineer's
certificate, Aadhar card of promoters, T&CP and 18 documents including
administration permissions have to be included with the application.
One can file a complaint with the Real Estate Regulatory
Authority or Adjudicating Officer under Section 31 of the Real Estate
Regulation Act 2016. These mainly include complaints against promoters,
allottees or real estate agents. RERA has been made irrevocable in the rules of
most of the states.
In which there is a form and procedure to make a complaint,
if the rules are violated in the project registered under RERA, then within the
stipulated time limit, a complaint can be lodged against them. Before the
preliminary hearing of compensation under RERA, the complainant has to file an
application before the Adjudicating Officer, the application should be in the
prescribed format, with all the particulars required by the RERA authority.
There is no time period prescribed in the Real Estate Act
for lodging a complaint, under the rules of RERA, the complainants have to
follow the time period for initiation of proceedings as prescribed in the
Limitation Act, 1963. The time period under this Act will depend on the claims,
a complaint can be made to the RERA Authority after the action taken on account
of the complaint to get immediate interim relief.
